How 360Eyes Pro collects, uses, transfers, stores, and discloses your personal information

360Eyes Pro ("we," "us," or "our") is committed to protecting the privacy of visitors to our website and users of our mobile applications, products, and services (each a "Service," and collectively the "Services"). When you access, browse, or use the Services, information is collected, transferred, processed, stored, and disclosed in accordance with this Privacy Policy (the "Policy"). This Policy applies to the information collection and disclosure practices of the Services. By accessing, browsing, or using the Services, including registering an account within our Services, you expressly consent to the collection, transfer, use, processing, and storage of your information (including personal information) as described in this Policy. If you do not agree with this Policy or with the information collection, use, and disclosure practices described in it, please do not use the Services or register an account.
When you visit the website without registering, you can browse without submitting any personal information about yourself. If you register an account within the Services or access the Services, we collect certain personally identifiable information from you, including your full name, username, email address, and a password of your choosing. As you interact with the Services, we also receive and store certain other types of information that does not generally identify you directly. For example, we automatically receive and record server log information from your browser or device, including your IP address, browser type and language, referring/exit pages and URLs, other browsing history, device type, Wi-Fi network information (including name and password), platform type, number of clicks, landing pages, cookie information, the pages you request and view, the time spent on particular pages, and the date and time. This section of the Policy outlines the various ways in which information is collected from the Services. Please read this Policy in full before using the Services or submitting information to us.
(a) Registration and sign-in. Certain Services require you to register an account and/or sign in with credentials. You may register an account through our account registration system or through a third-party website or service such as Facebook (an "Account"). When you register an account, you will be asked to provide certain personally identifiable information, such as your full name, email address, phone number, camera SN code, and a username and password of your choosing. When you are asked to create an account using the credentials of a third-party website or service, you will be asked to enter a username, password, and other information to verify that you own an account with that third-party website or service. When you provide the credentials of a third-party website or service, we may use those credentials to obtain information about you from that third party. For more information, see Section 1.4 (Information from Other Sources) and Section 3.5 (Social Networking Sites). When you register an account and sign in to the Services, you must provide current, complete, and accurate information. You are responsible for keeping your information up to date. If you do not provide complete and accurate information, or if you fail to update your information to keep it current, we are not responsible for any problems, interruptions in access, or liability that may result.
(b) Product setup. To use certain products (such as our camera products), you need to associate the product with your account by following the instructions provided with the product. When you associate a product with your account, you need to provide Wi-Fi network information (including username and password) and a unique identifier associated with your account (for example, by scanning a QR code we provide to you). Once a product is associated with your account, it remains associated until you unbind the product from the account or terminate your account.
(c) Communications. If you send us personal correspondence (such as an email or letter), or if other users or third parties send us information about your use of the Services, we may keep that information in a profile specific to you.
(d) Information you provide to others. You may choose to share information with third parties by "sharing" videos and photos with social networking sites (such as Facebook and WeChat (the "Social Networking Sites")). For more information, see Section 3.5 (Social Networking Sites).
We collect certain information about you and any product or device you use to access or use the Services through various technologies. In general, information collected automatically about your use of the Services does not directly identify you, and may include your diagnostic log information, IP address, browser type and language, referring/exit pages and URLs, other browsing history, platform type, clicks, landing pages, cookie information, the pages you request and view, the time spent on particular pages, the actions taken within the app, information about the app installed (OS type/version, network, etc.), and the date and time. We collect this information for the purposes described in this Policy, including to better understand our customer base and improve the quality of our Services.
(a) Video transmission. The primary method of video transmission from our camera products to our mobile applications is through a peer-to-peer connection. When unreliable peer-to-peer network conditions are encountered, the camera may choose to relay video to the mobile application through our servers in order to provide the best viewing experience. In this case, both the video and the transmission channel are securely encrypted. Our servers act only as a relay agent and do not store the video content transmitted through them or through the Services we provide.
(b) Video storage. When the camera detects activity, as long as you have activated the "Activity Alerts" feature in the camera's mobile application, separately encrypted video (no longer than 6 seconds) may be transmitted to and stored on our servers. If you do not delete video stored on our servers, it should be automatically deleted on a regular basis (typically 7 days), but we cannot ensure that residual copies in other locations (such as caches or backups) do not survive.
(c) Cookies. Cookies are small text files stored on a user's computer. Our third-party analytics providers use cookies to record information about your activity on the Services so that they can "remember" you when you return to the Services. Some cookies remain on your computer or device until you delete them. Others (such as session ID cookies) expire when you close your browser. You can configure your browser settings to attempt to reject cookies, but you may still use the Services. For more information on how the Services respond to browser settings, see the "Do Not Track Settings" section below. We do not control third parties' use of cookies. For more information, see Section 4 (Third-Party Providers), and review the privacy policies of all third-party providers to learn more about third-party cookies.
(d) Pixels (also known as web beacons / web bugs / JavaScript). Pixels are tiny graphics with a unique identifier used to track the online movements of web users. Unlike cookies, which are stored on a user's computer hard drive, pixels are tiny graphics about the size of the period at the end of a sentence, embedded invisibly at the end of a web page or in HTML-based email. Our third-party analytics providers may place pixels within our Services to track the other websites you visit (before and after visiting the Services). Our third-party analytics providers use the information obtained from pixels to help us improve our business and Services. We do not control third parties' use of pixels. For more information, see Section 4 (Third-Party Providers), and review the privacy policy of each third-party provider to learn more about third-party pixels.
We may obtain personal and non-personal information about you from business partners, contractors, social networking sites, and other third parties, and add it to our account information or other information we collect. When you register or sign in to use our Services using your social networking site login and password, we also collect information from the social networking site. For example, our website allows you to create an account and sign in using your Facebook account credentials, and in addition to allowing you to sign in to the website and share videos with Facebook, we also use your credentials to obtain the following information from Facebook: Facebook username, first name, last name, and profile picture. The information we collect may depend on your privacy settings with the social networking site, so please refer to the social networking site's privacy and data practices.
We may use your personally identifiable information (including tracking information) to manage your account. We may also use it to operate, maintain, and improve the Services (including providing you with a more personalized experience); to communicate with you; to provide you with information about products and services (including those of third parties); for marketing; for research purposes; to resolve disputes; to collect fees; to detect and prevent error, fraud, and criminal activity; to assist law enforcement; to enforce this Policy and any terms related to our Services; and for any other purpose described in this Policy or that we describe to you at the time of collection.
We may use your personally identifiable information to send you emails or other communications related to your account or the Services, or to respond to your inquiries or requests. You may not opt out of receiving Service-related communications that are not promotional in nature. We may also send you marketing emails, surveys, or newsletters to notify you about products or services that may be of interest to you. If you would like to stop receiving our marketing emails, please click the unsubscribe link at the bottom of any marketing email you receive. If you choose to opt out, you will continue to receive Service-related emails.
We may use non-identifying information for any lawful purpose, including analyzing trends, research, administering the Services, tracking users' movements within the Services, and improving our business and Services.
In general, we will retain your information indefinitely, or for as long as required or permitted by law. If you cancel your account or your account is terminated, we may, but are not obligated to, delete information we collect or obtain from third parties, and we may continue to use and disclose it in accordance with this Policy.
We do not sell or rent any of your personal information to third parties for marketing purposes. However, we may disclose your information to any affiliated entity or organization, as well as to agents and service providers. We may also share non-identifying information with third parties for any lawful purpose, including analyzing trends, research, administering the Services, tracking users' movements within the Services, and improving our business, products, services, and Services. Affiliated entities' and organizations' use of the information will be subject to this Policy or to agreements that are at least as restrictive as this Policy. In certain circumstances, we may disclose your personally identifiable information as required by law; if we believe disclosure is necessary to protect our rights; to government regulatory agencies; to law enforcement authorities; in connection with any judicial proceeding, court order, subpoena, or legal process served on us or the Services; and in response to physical threats to you or others.
If we file for bankruptcy or engage in a business transition such as a merger with another company, or a purchase, sale, or reorganization of all or part of the Services or our business or assets, we may disclose your personal information, including to a prospective or actual purchaser in connection with one of these transactions.
Certain Services allow you to share access to your camera products with others. If you authorize a third party to share access to a camera by authorizing them within your account, the third party will be permitted to access that camera and record video from it until you remove them from the account. We recommend that you exercise caution and discretion regarding third-party access to your cameras, because we do not control the actions of any third party and cannot prevent them from sharing video obtained from your cameras with others.
In addition to setting up an account using Facebook credentials, certain Services may allow you to choose to share information and video captured by our camera products with social networking sites. When you choose to share with a social networking site, we may share your video or information, along with other personal information, with the social networking site. Information shared with a social networking site is subject to the social networking site's privacy policy and practices, and you should familiarize yourself with the social networking site's privacy policy and practices before sharing. Facebook's data policy is located at www.facebook.com/about/privacy.
We cannot ensure that all of your personal information will never be disclosed in ways not otherwise described in this Policy. For example, we may be required to disclose personal information to a government or third party in certain circumstances, a third party may unlawfully intercept or access transmissions or private communications, or users may misuse or abuse the personal information they collect from the Services. No data transmitted over the internet can be 100% secure.
We use third parties to help us operate and improve the Services. We may provide these third parties with the information we collect, and they may collect information about you and your use of the Services. We may provide third parties with the information we collect, which, unless otherwise specifically stated in this Policy, is governed by this Policy and may only be used by the third party to help us operate or improve our business or Services, and to provide services to us. We do not control the information collected by third parties and are not responsible for their use of that information. Please review their privacy policies to learn more about their information collection, use, and sharing practices.
We use Google (a third-party analytics provider) to collect information about the use of the Services and the users of the Services, including demographic information and interest-level information. Google uses cookies and pixels to collect demographic and interest-level information and usage information about users who visit the Services, including information about the pages where users enter and exit the Services, the pages users view within the Services, the time spent, the browser, the operating system, and the IP address. Cookies and pixels allow Google to recognize a user when the user visits the Services and when the user visits other websites. Google uses the information collected from the Services and other websites to share information about users with us and other website operators, including age range, gender, geographic region, general interests, and details of the devices used to visit websites and purchase items. We do not associate the information we receive from Google with any of your personally identifiable information. Keeping the personal information we collect secure is something we care about deeply. Although we have mechanisms in place to protect your personal information after we receive it, there is no guarantee that data transmitted over the internet or any other public network is 100% secure. When you provide information to the Services, you do so at your own risk.
The Services are directed to a general audience and are not intended for children under the age of 13. We do not knowingly collect personal information from children under the age of 13. If you discover that a child has provided us with personal information without parental consent, please contact us using the contact information in the Privacy Questions section at the bottom of this Policy, and we will take steps to delete the information and terminate the child's account.
California Civil Code Section 1798.83 permits California residents to request and obtain from us, once a year and free of charge, a list of the third parties to whom we have disclosed that California resident's personal information (as defined under that statute) for direct marketing purposes during the preceding calendar year, and the categories of personal information of that type disclosed to them. If you are a California resident and would like to make such a request, you may contact us using the contact information in the Privacy Questions section at the bottom of this Policy.
If you would like to cancel your account or update the personally identifiable information associated with your account, you can make such changes by signing in to the mobile application. If you do not want your information to be accessed or stored as described in this Policy, you should not access, use, or register an account within the Services.
We update this Policy from time to time. When we post changes to this Policy, we will revise the "Effective Date" at the top of this Policy. We recommend that you review our Services from time to time to inform yourself of any changes to this Policy or any other policies.
